How are legal fees calculated?
The information below is merely indicative. Portuguese law and the legal profession rules determine that lawyers cannot establish fixed prices before analysing a certain number of factors. Read more to understand how we establish our legal fees.
Portuguese law determines that legal fees need to be determined on a case by case analysis. This means that generally lawyers are not allowed to determine a fixed fee prior to analysing your case. We predict the amount of work, complexity of our work, and time spent, all in average. However, after analysing your request to incorporate a company, we may determine that the legal fees we indicated are either too low or too high in light of the complexity or lack of complexity, and time we expect to spend. In such case, if the fees are too high, we may reimburse you the difference; if we determine that the fees are too low, we will send you a proposal of services which you can refuse. In such case, we will reimburse you fully.

Simple! We have years of experience in the legal practice and we drew a line of business according to such experience. We determined the minimum, average, and maximum amount of time we can spend on a single project.
Since we decided to provide legal fees estimates for standard services (example, there are a number of other types of companies you can incorporate in Portugal but we only provide estimate legal fees for Sole Proprietorships, Private Limited Liability companies, and Public Limited Liability companies), we know with with accuracy the amount of time we will spend on your project.
Then we apply our hourly rate which can range from € 75,00 to € 120,00. We get a minimum and maximum by multiplying time x hourly rate.
Then we adjust that according to the complexity of the “case” (example: notice the difference between the estimate we provide for custom articles of organization for each type of company; it ranges between € 129,00 and € 349,00 although in all cases you can only submit 3 custom rules).

Government fees are fees charged by the government for incorporating a company in Portugal. You can either pay these fees yourself or transfer to us and we will pay the fees on site. That is a complex question. But lets try to make it simple.
First thing you need to know is that they are not established by law. However, the law determines a series of requirements and abstract frameworks that allow and must be present at the moment of determining the “price” for a legal service.
Hourly rates, flat fees, and success fees are all allowed (success fees cannot be the only factor though) by the Statutes of the Portuguese Bar Association under article 100º which says that legal fees must represent an adequate compensation for the services effectively rendered and must be paid in money.
In case a legal fees arrangement with a fixed fee is not written and agreed to prior to the services being rendered, the lawyer must present a legal services description.

Yes and no. After you submit your request to incorporate a company in Portugal we will analyse your request. If we determine that the complexity of your request is adequate we will be able to accept your request and proceed with the services. Otherwise, we may need to provide you with an alternative fees arrangement or reimburse you fully. It is your decision.
